General Terms of Service

1. Scope of Service

Ōtautahi Apparel provides custom apparel and creative services, including:

  • Branding, communication, and visual design

  • Custom apparel and promotional products

Each project or order will be confirmed through a quote or proposal outlining deliverables, timelines, and pricing.

2. Branding, Communication, and Design Projects

All branding and design projects are scoped individually. Pricing will depend on project complexity, design requirements, and usage rights.

We outsource our design work to trusted and approved designers. You’ll work directly with the designer to refine and approve your branding or artwork, and they will invoice you directly for their services. Ōtautahi Apparel will collaborate with the designer to ensure all final design files meet our printing and production requirements.

Process:

  • Discovery and briefing

  • Design development and presentation

  • Feedback and refinement

  • Delivery of final approved files

  • Final artwork and design assets will be delivered once full payment is received.

Revisions:

  • Each project includes one round of revisions unless otherwise stated.

  • Additional revisions or changes to scope will be quoted separately.

3. Custom Apparel and Promotional Products

Orders and payment:

  • A 50% deposit is required before production begins.

  • Full payment is required before delivery unless otherwise agreed.

  • Prices exclude GST.

  • Any post-approval changes or reprints will be billed separately.

Approvals and artwork:

  • All artwork and mock-ups must be approved in writing before production.

  • Once approved, production begins and further changes may not be possible.

  • Ōtautahi Apparel reserves the right to refuse designs that contain offensive, defamatory, or copyrighted content without authorisation.

Production and delivery:

  • Estimated timelines will be provided at order confirmation but may vary due to supplier or courier delays.

  • Ōtautahi Apparel is not liable for third-party delays, supply chain issues, or courier damage.

  • Clients are responsible for providing accurate delivery details.

Returns, refunds and cancellations:

  • All custom orders are final.

  • Returns or exchanges will only be accepted in cases of defective products or Ōtautahi Apparel error.

  • Cancellations after production begins may incur costs depending on the stage of manufacture.

  • Any defects must be reported within 7 days of delivery.

Product quality:

  • Ōtautahi Apparel partners with certified suppliers (SGS, OEKO-TEX® STANDARD 100, Platinum WRAP) to ensure quality and ethical production.

  • We are not responsible for normal wear and tear, improper care, or washing damage.

Pricing & payment:

  • All pricing is in NZD and excludes GST unless stated otherwise.

  • Invoices are due within 14 days of the invoice date.

  • Projects over $2,000 may require a deposit or staged payments. Any out-of-scope work will be quoted and agreed upon before proceeding.

5. Intellectual Property

  • Final design files, branding assets, and approved apparel designs become the client’s property upon full payment.

  • Ōtautahi Apparel retains ownership of all preliminary concepts and working files unless otherwise agreed.

  • Ōtautahi Apparel reserves the right to display finished work in our portfolio or marketing materials unless the work is commercially sensitive or you request otherwise.

6. Privacy & Confidentiality

We take privacy seriously. Any information or materials shared with us will be kept confidential and only used for the purposes of delivering your project.

7. Limitation of Liability

Ōtautahi Apparel’s total liability for any claim arising from services or products is limited to the total amount paid for that specific project or order.

We are not liable for indirect, incidental, or consequential damages.

8. Force Majeure

Ōtautahi Apparel shall not be liable for delays or failure to perform due to events beyond our control, including natural disasters, strikes, pandemics, or supplier disruptions.

9. Acceptance of Terms

By approving a quote, design proof, or invoice, you agree to these Terms of Service. If you have questions or would like clarification, we’re always happy to kōrero.
